What usage is permitted with the JollyPromos Template video Footage license?

The license starts when you read the terms and purchase your JollyPromos video ad Template. The JollyPromos video ad template license is the agreed terms below:

JollyPromos Template Promo Footage License

​

JollyPromos footage license is offered as the default option with each of our template videos, professional (single use only). This license entitles customers to share this footage with vast audience, depending on how it is being shared.

Subject to your compliance with the terms hereof, JollyPromos hereby grants you a limited, worldwide, royalty-free, non-exclusive, non-sublicensable and non-assignable right and license to use, stream, distribute, publicly perform and display each video created by JollyPromos.com for (a) your personal purposes, or (b) for your commercial purposes, including marketing purposes.

1. Licensed Content. We may use stock audio, images, or videos from third-party licensors (collectively, “Licensed Content”) for use in creating our original concept videos in our templates. Subject to your compliance with the terms set forth herein, you may: (a) use the Licensed Content available in your video solely for your company or individual single use. Our original video concepts are royalty free to use; and (b) distribute videos containing Licensed Content solely on or through, Websites, YouTube, Facebook, Instagram, Twitter, and other similar online platforms that allow users to upload and share content. You may not distribute videos containing Greg O'Rourke, JollyGrego.com Or JollyPromos.com Licensed Content through any other means without our prior written approval.

2. Restrictions. You may not (a) resell, re-edit in any way from original content including any and all voice overs or file-share Licensed Content separately from your videos; (b) use or distribute Licensed Content other than as expressly permitted herein; or (c) create works that contain, in substance, only Licensed Content. 

3. Intellectual Property. As between you and us, all Licensed Content is owned by the applicable licensor. All rights not expressly granted herein are reserved.

Permissions

• Web Use – Footage can be used on social media websites, in mobile apps and on sites such as YouTube or Vimeo. It can even be used in content that will be digitally downloaded.

• Live Performances – The footage can also be used at live performances such as musicals, corporate presentations, concerts and musicals.

• On Websites – Videos that are from the single use purchaser or company using their individual link, download embedded on actual web pages have no audience limit restrictions.

• Emails

• Mobile Devices

JollyPromos Video Template Footage permissions do not include:

(Please contact us if you wish your videos to be shown on Broadcast TV, Streaming Channels or Film)

*Broadcast

(a) Traditional television (e.g. terrestrial, cable or satellite TV,); or (b) Mobile or online substitutes for traditional television or  broadcast (e.g. mobile TV, IPTV (streaming TV or video-on-demand).

Indie Film

A film not for general theatrical release. “Indie Film” includes a student film, a film distributed on online user generated platforms, and a film festival screening.

• Television Distribution – The JollyPromos template footage license does not permit for any usage in television shows or commercials. Usage is also prohibited for distribution over any broadcast, cable or satellite.

• Movie Theater Distribution – Distribution in movie theaters is not permitted with the JollyPromos template promo footage license.

• Over the Top (OTT) Video Distribution – Over the top video distribution, or streaming services such as Netflix is not permitted by this JollyPromos footage license.

• You may NOT resell, redistribute or edit ANY template footage in any way from JollyPromos or Greg O'Rourke's original templates. JollyPromos promo/video templates and all the digital footage including production elements (characters, music, graphics, voice over, etc) must be purchased and licensed by each user. All JollyPromos Productions with the characters and story (script, characters, editing, voice over) are all the intellectual property of Greg O'Rourke and or JollyPromos.com. We may use stock audio, images, or videos from third-party licensors (collectively, “Licensed Content”) for use in creating our original concept videos in our templates. All Licensed Content is owned by the applicable licensor. All rights not expressly granted herein are reserved.

• Simple guidelines on what's not allowed

        You can't re-sell, or re-distribute items;​

        You can't use items in on-demand services; and

        You can't use items as the basis for merchandising. For example, printing a JollyPromos and or Greg O'Rourke's                         Characters onto a T-shirt is not allowed.

Our audio file content:  royalty free audio content files for our template videos or original audio and original video productions:

For music Items, the rights granted under this license are subject to the following restrictions:​

1. JollyPromos Template video music beds are to be used only in the videos created by JollyPromos/Greg O'Rourke and may NOT be used in  any other stand alone format.

2. Music, public performance rights are not included with this license. Music is limited to the video creation.  

3. The original author of the Item retains ownership of the Item. You can’t claim ownership of the Item, even if modified in accordance with this agreement, for example through content identification systems.
   Example: if you use a music track synced in your video, you can’t claim rights to the music (e.g. through applying “Content ID” or similar systems to the music in your video).
